Royalty-free product license

This license applies to downloadable samples, loops, MPC programs, synthesizer presets and other audio production assets supplied by El Magico Beats (“Licensed Content”). By purchasing or using Licensed Content, you receive the rights described below, subject to mandatory law and the license terms presented at the time of purchase.

1. License grant

After a valid purchase, we grant the purchaser a worldwide, perpetual, non-exclusive, non-transferable, royalty-free license to use the Licensed Content in original musical and audiovisual productions, including commercial productions, subject to the restrictions below. No additional royalty is owed to us for permitted uses. This is a license, not a sale of copyright in the source material.

2. Permitted uses

  • Compose, record, edit, chop, process, resample and combine Licensed Content with other material in original productions.
  • Distribute, stream, perform, monetize and synchronize finished songs, beats, soundtracks and audiovisual productions, including in film, television, games, advertising and online video.
  • Sell or lease finished beats to clients, provided you do not purport to transfer exclusive ownership of the underlying Licensed Content.
  • Deliver stems reasonably needed to produce, mix or master a finished work, provided recipients do not receive independent rights to reuse the isolated Licensed Content in unrelated projects.

3. Prohibited uses

  • Sell, sublicense, share, upload, distribute or give away the Licensed Content as standalone sounds, isolated loops, presets, sample packs, construction kits, sound libraries or other reusable production assets, whether modified or not.
  • Make the Licensed Content available through a shared asset repository, marketplace, file-sharing service or downloadable project in a way that permits extraction and reuse outside the finished production.
  • Use the Licensed Content as training, fine-tuning, evaluation or dataset material for machine-learning or generative-AI systems without our separate written permission.
  • Claim exclusive ownership of the Licensed Content, register the isolated sounds or substantially unmodified versions as exclusive fingerprinting references, or interfere with other lawful licensees.
  • Remove embedded rights notices or misrepresent yourself as the original creator of the Licensed Content.

4. Content identification systems

You may register your original finished recordings or compositions with rights-management systems where permitted by those systems. You must not submit non-exclusive Licensed Content itself as an exclusive reference. If your registration causes claims against another lawful licensee, you must take reasonable steps to release or resolve those claims. You are responsible for complying with the platform's rules concerning non-exclusive samples.

5. License holder and collaborators

The license is granted to the individual or legal entity identified as purchaser. Collaborators and service providers may handle Licensed Content solely to work on that purchaser's productions, under the purchaser's supervision, and must not retain or reuse the source assets for independent projects. A purchase is not a shared library license for multiple independent creators. Contact us for multi-seat or organization-wide licensing.

6. Ownership and third-party rights

We and our licensors retain all rights in the underlying Licensed Content. You retain the rights you hold in your original contributions to works made with it. Our royalty-free permission covers only the Licensed Content we are authorized to license; you remain responsible for obtaining rights to other material incorporated into your productions and for complying with applicable laws and platform requirements.

7. Duration and violations

The license is perpetual for compliant uses and does not expire merely because an email download link expires or a store account is deleted. If you materially violate this license, we may notify you and request that you remedy the violation where reasonably possible. We may terminate the license for an unremedied material breach, subject to mandatory law. Termination does not retroactively invalidate lawful finished productions distributed before termination, but does not authorize new prohibited uses.

8. Changes and questions

The version of the license supplied with your purchase governs that purchase. Later changes do not retroactively reduce rights already granted. For additional permissions or questions, contact support@elmagicobeats.com.
